Pros & Cons List

Binding Agreement. These Terms govern visitors' access to and use pros-cons-list.com (the "Site"). The owner of the Site ("We") may automatically upgrade the Site, and these Terms will apply to such upgrades. By accessing or using the Site, you agree to be bound by these Terms. If you use the Site on behalf of an organization, you agree to these Terms on behalf of that organization. If you do not agree to these Terms, you may not use the Site.

Privacy. We collect information about visitors to the Site in a few different ways: we collect certain information that visitors provide to the Site, we collect some information automatically, and we collect information generated through visitors' use of the Site.

We collect the information that web browsers, mobile devices, and servers typically make available about visitors to the Site, such as the IP address, browser type, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information. We may determine the approximate location of your device from your IP address. We may use cookies and other technologies like pixel tags to help us identify and track visitors, usage, and access preferences for our Site, track and understand marketing campaign effectiveness and to deliver targeted ads, and improve the Site and its user experience.

We may share limited data with third-party service providers as reasonably necessary to operate the Site and its features, including generating pros and cons, detecting abuse, enforcing usage restrictions, debugging issues, and maintaining security.

Third-party services that we use to provide the Site, including content moderation and generation services, may process and retain information under their own terms, policies, and legal obligations. We do not control those third-party practices.

We do not sell our visitors' data.

User Content. You are solely responsible for any text, prompts, or other content you submit to the Site, including through this feature. You represent and warrant that you have all rights necessary to submit that content and that it does not violate any law or infringe any third-party right. You may not use the Site to submit unlawful, abusive, harassing, defamatory, infringing, or otherwise prohibited content, or to test, evade, or circumvent safety or moderation measures.

Age Restrictions. The Site is not intended for visitors who are under the age of 13. By visiting the Site, you represent and warrant that you are 13 years of age or older.

Changes. We may modify the Terms from time to time, for example, to reflect changes to the Site or for legal, regulatory, or security reasons. If we do this, we'll provide notice of the changes by updating the 'Last Updated' date. Any changes will apply on a going-forward basis, and, unless we say otherwise, the amended Terms will be effective immediately. By continuing to use the Site after we've notified you, you agree to be bound by the new Terms. You have the right to object to any changes at any time by ceasing your use of the Site.

Termination. You are free to stop using the Site at any time. We also reserve the right to suspend, restrict, or end your use of the Site, or any feature of it including this feature, at any time at our discretion and without notice. For example, we may do so if you fail to comply with these Terms, if your use creates or may create legal liability, security risk, abuse risk, or operational burden for us or our providers, if your submissions are flagged by moderation or safety systems, or if you attempt to bypass any usage limits, moderation, or safeguards.

Limitation of Liability. We shall not have any liability for any indirect, incidental, consequential, special, exemplary, or punitive damages under any theory of liability arising out of, or relating to, these Terms or your use of the Site, including any generated output, blocked or restricted requests, moderation or enforcement decisions, or any act, omission, outage, or failure of any third-party service provider. As a condition of access to the Site, you understand and agree that our liability shall not exceed $5.

Indemnification. You will indemnify, defend, and hold the Site, its owners, subsidiaries, affiliates, officers, and employees harmless from any and all claims, damages, losses, liabilities, actions, judgments, costs, and expenses (including reasonable attorneys' fees) brought by a third party arising out of or in connection with: (i) any act or omission by you in connection with your use of the Site, (ii) your content or submissions, or (iii) your breach or alleged breach of any of these Terms. The Site may, at its option, elect to take over control of the defense and settlement of a claim subject to indemnification. You agree not to settle any such claim without the prior written consent of the Site.

Governing Law. You agree that these Terms, and your use of the Site, are governed by Massachusetts law, in the United States of America, without regard to its principles of conflicts of law.
